Understanding Your Personal Worldview Understanding your personal worldview is important because this is how we assess all aspects of life the world around us and our place in it. The Christian worldview the laws of logic are universal and unchanging because they reflect the nature of the living God. How do people define the terms God, Ethics, and Knowledge? How do the terms affect the daily lives of others? I have found during my worldview search, that these three components play a huge role in how I shape my thoughts experiences, education, and life decisions. My beliefs about the existence and the character of God (Theology), the nature of Knowledge (Epistemology), and discussing the main question is truth relative? In addition I have discussed my beliefs about Ethics (Morality) and who is right and wrong? Who defines right and wrong? Are the moral laws the same for all people in all cultures? It is difficult for the natural man to believe in something he cannot see, touch, or feel (1Cor.2:14).The question for the Christian is solved with the first verse in the Bible. In the beginning God created the heaven and the earth (Gen.1:1) the greatest proof in addition to scripture is our daily fellowship in prayer, Gods revelations and our personal experiences. (Psalms 19:1) states The Heavens declare the Glory of God and the firmament shows His handy work. This passage is clearly saying there is no excuse for man not to believe in God, for the beauty and the glory of the Heavens speak loudly saying God exists. Knowledge is possible because of how God has made us. We learn from our senses our experiences, but all true knowledge is ultimately dependent upon God. (Proverbs1:7).The fear of the Lord is the beginning of knowledge: but fools despise wisdom an instruction. Ethics, or that which is good, is a reflection of the character of God. God is the standard of good by which all things are measured, and his standards are revealed through his word. Moral laws are pretty much the same in all cultures, but their moral reasoning can be different depending on the specific culture. But seek first the kingdom of God and His righteousness, and all these things shall be added to you.(Matthew 6:33). The only real ethic is to glorify God by having faith in him and giving his kingdom priority in our lives. God has given us his revelation and to guide us in ethics, in knowing what we should and should not do. The book of Proverbs was given to us to teach us the right conduct. To know wisdom and instruction; to perceive the words of understanding, to receive the instruction of wisdom, justice and judgment, and equity: to give subtlety to the simple, to the young man knowledge and discretion. A wise man will hear, and will increase learning; and a man of understanding shall attain unto wise counsels. The fear of the Lord is the beginning of knowledge: but fools despise wisdom and instruction. Clearly the Bible teaches that truth is absolute and that it exists under the authority and revelation of Jesus Christ. Religion describes our connection to God as the one thing that exists. From this foundation we see the clear connection of how our worldviews are formed. Understanding ones personal and Christian worldviews are important, because they are determining factor of our moral code and ethics, and other beliefs. These worldviews give us a general picture of all reality, which we relate our experiences and knowledge. It helps us to put our daily experiences and choices into clearer prospective. (Cosgrove, p. 28) As a Christian my worldviews are important for my on salvation, for the well-being of my family, for the betterment of my community and workplace. A Christian worldview is powered by knowing the Spirit that lives inside of us is greater than the spirit who lives in the world. I can do no less than to love the Lord thy God with all my heart and soul. The same came for a witness, to bear witness of the light that all men through Him might believe.(1 John 7) Conclusion In conclusion the personal world view is a substantial part of how we relate to life, world events, each other, and helps us determine our part in this introspective living experience. The Christian Worldview and how it supports Christianity, which is necessary in building a relationship with the Living God. People across the world have their individual personal views relating to God, ethics, and knowledge and strive to perfect their religion, which is necessary in building a relationship with the creator.

Cyprus - History Of The Conflict Cyprus, an island in the Eastern Mediterranean, at the cross-roads of three continents - Europe, Asia and Africa - has one of the oldest histories of the world, dating back 9000 years. Its strategic position, its wealth in forests and mineral deposits, as well as its skilled craftsmen, made it the prized possession of the powers of the day. Cultural influences came from all directions - all major regional civilisations left their mark on the island, contributing to the development of a very rich and diverse cultural heritage. ANCIENT TIMESThe Stone Age The first signs of human life on the island date back to c. 8500 BC during the Palaeolithic period. Evidence of human activity was found in cave dwellings near Liopetri, though it is not known whether they were just hunting parties passing through or permanent settlers. The first undisputed settlements are believed to have been established towards the end of the 8th millennium BC. Vestiges of such early communities are found all over the island, such as at Khirokitia, Kalavasos-Tenta, Apostolos Andreas-Kastros, Phrenaros, Petra tou Limniti. Neolithic Cypriots built circular houses with small undressed stones for the lower structures and sun-dried mudbricks and clay for the middle and superstructure. The Khirokitia neolithic settlement in Larnaca district stands out as a striking example of prehistoric architecture. The Bronze/ Copper Age Large copper deposits brought fame and wealth to the island and may have even given it its name. It has been documented that during the bronze age Cyprus had intense commercial relations with the main commercial and cultural centres of that time. During this period metallurgy and pottery flourished while close relations developed, particularly with Crete, which are also expressed in the Cypro-Minoan script which appeared in Cyprus around 1500 BC. Of special significance for the future of Cyprus was its colonisation around 1200 BC by Mycenaean and Achaean Greeks, a migration process that lasted for more than a century. They brought with them to the island the Hellenic language, culture and religion. Legend has it that the first Hellenes who settled in Cyprus were heroes of the Trojan war. The arrival of the Achaeans greatly influenced town planning, architecture, and pottery. Since then Cyprus has remained predominantly Greek in culture, language and population despite influences resulting from successive occupations. Children as young as 3 are already worrying about their appearances, as seen on the television shows such as ‘Toddlers and Tiaras. ‘ I believe the media has a much stronger impact on teenagers than any other age group. Everywhere you go, there will always be that â€Å"look,† that celebrities have and that every young person aspires to look like.Teenage girls will go to all extents in order to achieve the media's perception of a beautiful woman, when in fact few teenagers know that what they are seeing In magazines and on billboards are not In fact real humans, but they are what society has created. When parents think their children are safe at home, they are wrong. Young people's minds are being filled with poison which is also known as the perfect image.Shows such as ‘ Keeping up with the Sardinian,' Toddlers and Tiaras,' ‘America's next top model,' ‘Jersey Shore,' and '16 and Pregnant,' are giving teenagers the wrong idea that you must be ‘slim, fake, very award, and covered In make-up' to be considered anything near beautiful. Shows such as these are giving the Impression that you must be a specific way to be successful and/or notorious. This already creates large numbers of very unconcealed women, as they feel they are not ‘beautiful, ‘because they are not covered in make-up.These types of situations create stress for teenagers as they feel they must look a certain way to be deemed beautiful. When asked, 87% of British teenagers claimed to be unhappy with their physiques and 64% of those under 13 had already turned to tenting In order to lose weight as stated by In the Dally Mall Newspaper article. Many teenagers are pressured by their families Into doing well in their GASES_ This makes them feel like they must do well in order to keep their families happy. I can speak from personal experiences when I say that I felt even more pressured because I knew that my family were expecting good grades from me.This creates a large amount of stress for teenagers as they feel they must do well in order to make their families proud and In order to go to university to get a good job. It is said by the majority of the elder generation that going to university means that you will have a better future as you will get a good Job, which entails a larger salary as opposed to someone who did not attend university. This is not necessarily true as people who do not attend university can still manage to get a well-paid Job. Also, family members may expect their child to do a specific profession which the child themselves does not want to do.This means that the teenager Is pushed into schools which allow the best support in he subjects which will open pathways to these careers. This can also create higher levels as s tress as teenagers are being forced Into doing a subject they do not wish to do, which makes it more challenging to succeed, thus creating more stress. The teenagers which come from working class families, unfortunately, have it a lot harder than those that come from middle class or upper class families. A working class teenager may be pressured by their families to get a job as soon as possible in order to help out their living situation.This can create stress because distributing enough mime for school and work can not only be exasperating but It can also be difficult. At the case for those which come from working class families. Not only can teenagers be stressed from working, they can also be stressed as they are being put into a situation where money is a problem and they are constantly living under the threat that certain necessities may be cut off due to an outstanding bill payment or something as extreme as being kicked out the house. Society has a large impact on the amount of stress that a teenager has.By society I mean all things surrounding hem, media (as I previously discussed), friends, and the general public. Whether you want to admit it or not, everywhere you go, everything you do, you are always being judged, by everyone. Many people are aware of this whilst others aren't. The fact that we live in a country where everyone is Judged by the color of their skin, the way they present themselves and by their appearances makes it a more difficult place to fully be accepted. This applies stress to young people as they feel they need to be accepted in society by becoming something that they are now.The factor which disheartens me the most is that in society you are expected to be a specific way In order to be accepted and if you are anything other than ‘perfect,' you are looked upon as ‘morally wrong. ‘ Which leads me onto my next point, the general public (specifically the older generation) has generalized teenagers as being anti-so cial and rude when in fact only a minority of teens are actually this. By generalizing an age group based upon a few individuals can make it more challenging for the younger generation to speak their mind and have their voices heard.This also creates stress by making teenagers feel as if they are not important because of what they are depicted as. To sum up, teenagers have many reasons to feel like they have a build-up of stress, but I believe the two main factors are family and education as most of teenagers spend the majority of their time either in school and/or in the presence of their families. This means that they are constantly being told what to do, what to achieve and what is expected of them. Which makes life as a teen more difficult than it needs to be.

Compensation and benefits concerns are very important to employees and employers. A lot of the top performing employees are drawn by successful organizations, as well as the organization providing a detail compensation and benefit plan. Now it is time to focus on the performance management structure that will help you succeed in your business. In this document I will focus on different aspects that will help you launch a well-done performance plan. This plan will also help you increase the performance of your associates and prevent a high turn over. Performance management is part o Lean Manufacturing, and even though your company does not belong to manufacturing, we can implement it and get good results. Performance Management is about letting you employees know the health of the company and taking the appropriate actions to prevent a decrease in performance, efficiency, high costs, etc. The first objective in implementing Performance Management is that there must be a commitment between the associates and the organization to improve the performance. Communication plays an important role here, the objectives must be clear in order to have a good communication between departments and this will arises alignment. As part of having a good communication, employees must have clear their responsibilities, goals ad how they are performing. You must also be prepared to correspond to the good performance of your associates; you must also create a plan for professional growth for them. Associates tend to be motivated and work as a team in continuous improvement projects and finding ways to improve the quality of the organization. The second objective would be setting up system a method to measure the  performance of your employees. We already talked about how to measure the health of your company and we talked about Key Performance Indicators as a method to measure the objectives of your different departments. Now it is time to go a little bit deep and set up a method for measuring the performance of your employees. During a performance appraisal you must abroad skills, ethics, how he/she is performing according to the tasks that are cited in the job description. There is not a specific method for measuring the skills of an associate, what is really important is to monitor your employees on a consistent basis. An employee appreciates to know where he/she stands and know what he is doing right or the things that need to be improved. 360-degree feedback is a method that I would like to recommend. The reason is that in this method the employee not only receives feedback from the supervisor; peers, subordinates or even customers if applicable provide feedback. Obviously this method involves more and provides a better picture. I can provide more specific information or if you want to use the traditional way is correct. Third, so far we have covered the base. Now it would be time to execute what has been planned. In this step I would like to cover how to convince your people that Performance Management is important. Your supervisors must understand that if something is not measured it cannot be improved, and that associates are important for the success of the company. Performance Management is a cycle where data is collected, analyzed, it is seen if there is room for improvement and then action is taken to make the corrections needed. I recommend the usage of board to communicate the performance of your employees and at some point build an internal competition in order to reach better results. These board also helpful for monitoring and you can even add a log of corrective actions with responsible and due dates. Here is an example of the information that I used to post in another company. Every operator used to receive weekly feed back about their performance and at the end of the month the results were posted and they knew the bonus percent they has earned. As far as daily information transmitted to the  associates, s software was bought and we configured every machine with the appropriate standards and the associates were able to see the weekly schedule, plan fulfillment, performance, waste, etc. This company in specific belongs to another industry but the purpose is the same. Also, keep in mind that at the end customer satisfaction is almost the most important thing. Finally, I would like to make some comments regarding how to provide feedback to the employees, As mentioned before, feedback is important to help employees perform at their best. You will notice that Performance management is being effective when they ask how they can improve and what are the things that are doing right. This practice will lead you to create a training plan or training matrix. The information provided must be specific and if possible with examples. Also, let them speak and listen to what they tell. Keep in mind that at the end, they are the one that are in contact with the process. In conclusion, motivation is very essential for every person in your business and every body must keep in mind that what they do is important for your clients. William Henry Harrison Fast Facts William Henry Harrison (1773 - 1841) served as Americas ninth president. He was the son of a signer of the Declaration of Independence. Before getting into politics, he made a name for himself during the Northwest Territory Indian Wars. In fact, he was known for his victory at the Battle of Fallen Timbers in 1794. His actions were noticed and allowed him to be present at the signing of the Treaty of Grenville which ended the wars. After the treaty was completed, Harrison left the military to become involved in politics. He was named the Governor of the Indiana Territory from 1800 to 1812. Even though he was the governor, he led forces against Native Americans to win the Battle of Tippecanoe in 1811. This fight was against a confederacy of Indians led by Tecumseh along with his brother, the prophet. The Native Americans attacked Harrison and his forces while they slept. In retaliation, they burned Prophetstown. From this, Harrison received the nickname, Old Tippecanoe. Through research of early examples of childhood this essay sets out to describe how contemporary thinking of childhood has developed through complex patterns of sociological deliberation and political, cultural and historical pressures. Work of Art Titles Work of Art Titles Work of Art Titles By Maeve Maddox When a freelance magazine writer asked me how the title of a sculpture should be written, I went to The Chicago Manual of Style to find out if it should be italicized, enclosed in quotation marks, or left plain. Here is the advice I found and passed on to the writer: Titles of paintings, drawings, photographs, statues, and other works of art are italicized, whether the titles are original, added by someone other than the artist, or translated. The names of works of antiquity (whose creators are often unknown) are usually set in roman. Though major works of art are generally italicized, some massive works of sculpture are regarded primarily as monuments and therefore not italicized. According to this advice, one should italicize Kindred Spirits (oil painting), Shore Lunch (non-monumental sculpture), and Rose and Driftwood (Ansel Adams photo), but leave the Venus de Milo (work of antiquity) and the Statue of Liberty (monumental) in roman type. After the fact, I checked to see what The AP Stylebook has to say about italicizing titles. The AP editors are against it: italics: AP does not italicize words in news stories. According to AP guidelines, the titles of just about everything are enclosed by quotation marks: book titles, computer game titles, movie titles, opera titles, play titles, poem titles, song titles, television program titles, and works of art. Exceptions are the Bible and books that are â€Å"primarily catalogs of reference material.† I decided to explore a few publications, American and British, to see how they do it. Two (both British) write the titles without italics or quotation marks. Four (all American) enclose the titles in quotation marks. Only one (also American) italicizes art titles, including works from antiquity. Here are seven of the examples I gathered: The Telegraph (British) I can hardly bear to look at a horrible little painting of a cloyingly sweet faced little girl entitled The Strawberry Girl, where the paint texture and layers of discoloured varnish were flattened during an early re-lining resulting in the ruin we see today The Independent (British) His giant sculptures, many of them human figures, include Yellow, a man ripping open his own chest and spilling out Lego innards (11,014 pieces make up the work), and a blue swimmer, as well as interpretations of masterpieces including the Mona Lisa The New York Times (American) The show includes works on loan as well as some of the gallerys recent acquisitions that have not been on view before, such as Frantisek Kupkas Organization of Graphic Motifs and Yves Tanguys The Look of Amber. Kuhn staged his first exhibition in 1905 at Salmagundi Club, presenting himself both as a serious painter and a cartoonist. In the same year, Kuhn submitted his first illustration of the LIFE magazine. (Meally, Robert G., and Romare Bearden, 19) Kuhn in most of his time spent his summer in Fort Lee in New Jersey. By adjusting his expectations, Levi adjusts his will to live. And even more soothing is the prospect of sleep. Any point in which the men can lie down, close their eyes, cover themselves with blankets, is a moment of relief. He relates with joy his assignment to a hospital bed: "a miracle! It is empty! I stretch myself out with delight; it is the first time since I entered the camp that I have a bunk all to myself. Despite my hunger, within ten minutes I am asleep" (Levi 50). In "A Good Day," the presence of the sun makes life a little more bearable. It is a thing that, as free man, they took for granted. Now, "I understood how men can worship the sun" (Levi 71). And even less than a sunny day can help the men bear their burdens. For instance, "The latrine is an oasis of peace" (Levi 68), and other small facets of a typical daily cycle provide a break from the insanity of the Lager. Beside the regular meals and rest hours, the mere anticipation of a break, which "can be almost glimpsed in the fog of the remote future, allowing us to derive a little more strength from the expectation" (Levi 69), is enough to keep him going just a little while longer. In the lager, Levi learns to live in the moment. If something good happens, he will be present and enjoy it as much as he can, without painful thoughts of past or future. When he finds himself in a beautiful, clean, warm laboratory, almost reminding him of his old life, he says, "All this is a gift of fortune, to be enjoyed as intensely as possible and at once; for there is no certainty about tomorrow" (Levi 140). John Steinbeck’s novel, The Grapes of Wrath is one of the most influential books in American History, and is considered to be his best work by many. It tells the story of one family’s hardship during the Depression and the Dust Bowl of the 1930’s. The Joads were a hard-working family with a strong sense of togetherness and morals; they farmed their land and went about their business without bothering anyone. When the big drought came it forced them to sell the land they had lived on since before anyone can remember. Their oldest son, Tom, has been in jail the past four years and returns to find his childhood home abandoned. He learns his family has moved in with his uncle John and decides to travel a short distance to see them. He arrives only to learn they are packing up their belongings and moving to California, someplace where there is a promise of work and food. This sets the Joad family off on a long and arduous journey with one goal: to survive.   Ã‚  Ã‚  Ã‚  Ã‚  In this novel Steinbeck set forth with the intention of raising awareness to the general public of the difficulties and injustices these migrants faced during this period in time. It exposed the methods of the California farmer to use the migrants in order to lower their costs and make their profit margin higher. How they starved and cheated the poor, working man, in order to keep him desperate for food and too weak to protest. Above all, it showed everyone that these â€Å"damn Okies† were all simply men, women and children, no different from anyone else, just poorer. They were human beings with feelings and not the uncivilized beasts they were portrayed as at the time. Steinbeck portrays the â€Å"Okies† in a way no one before him had, and also managed to keep their story true to life. He did this by mainly using dialect, and wrote the â€Å"Okie† dialect just as it was spoken, breaking the lines of proper grammar and spelling. If he was con cerned with such things it would have ruined the personality of the characters. Common Law Versus Civil Law Systems Essay

The two principal legal systems in the world today are those of civil law and common law. Continental Europe, Latin America, most of Africa and many Central European and Asian nations are part of the civil law system; the United States, along with England and other countries once part of the British Empire, belong to the common law system. The civil law system has its roots in ancient Roman law, updated in the 6th century A.D. by the Emperor Justinian and adapted in later times by French and German jurists. The common law system began developing in England almost a millennium ago. By the time England’s Parliament was established, its royal judges had already begun basing their decisions on law â€Å"common† to the realm. A body of decisions was accumulating. Able lawyers assisted the process. On the European continent, Justinian’s resurrected law-books and the legal system of the Catholic Church played critical roles in harmonizing a thousand local laws. England, in the midst of constructing a flexible legal system of its own, was less influenced by these sources. It never embraced the sentiment of the French Revolution that the power of judges should be curbed, that they should be strictly limited to applying the law such as the legislature might declare. Thus, British colonists in America were steeped in this tradition. Indeed, among the grievances enumerated in the American Declaration of Independence were that the English king had deprived the colonists of the rights of Englishmen, that he had made colonial judges â€Å"dependent on his will alone for the tenure of their offices† and that he had denied the people â€Å"the benefits of Trial by Jury.† After the American Revolution, English common law was enthusiastically embraced by the newly independent American states. In the more than 200 years since that time, the common law in America has seen many changes — economic, political and social — and has become a system distinctive both in its techniques and its style of adjudication. It is often said that the com mon law system consists of unwritten â€Å"judge-made† law while the civil law system is composed of written codes. For the most part, law in the United States today is â€Å"made† by the legislative branch. To some extent, however, the judge-made law analogy is true. Judicial independence is a hallmark of the American legal system. As a co-equal branch of government, the judiciary — to a remarkable degree — operates free of control by the executive and legislative branches, deciding cases impartially, uninfluenced by popular opinion. The American people respect their courts and judges, even if they sometimes criticize them. In this contrast of common v. civil law, U.S. District Court Judge Peter Messitte (Maryland), considers some basic aspects of both systems and explains how the American common law system compares with that of civil law.Historically, much law in the American common law system has been created by judicial decisions, especially in such important areas as the law of property, contracts and torts — what in civil law countries would be known as â€Å"private delicts.† Civil law countries, in contrast, have adopted comprehensive civil codes covering such topics as persons, things, obligations and inheritan ce, as well as penal codes, codes of procedure and codes covering such matters as commercial law. But it would be incorrect to say that common law is unwritten law. The judicial decisions that have interpreted the law have, in fact, been written and have always been accessible. From the earliest times — Magna Carta is a good example — there has been â€Å"legislation,† what in civil law systems would be called â€Å"enacted law.† In the United States, this includes constitutions (both federal and state) as well as enactments by Congress and state legislatures. In addition, at both the federal and state levels, much law has in fact been codified. At the federal level, for example, there is an internal revenue code. State legislatures have adopted uniform codes in such areas as penal and commercial law. There are also uniform rules of civil and criminal procedure which, although typically adopted by the highest courts of the federal and state systems, are ultimately ratified by the legislatures. Still, it must be noted that many statutes and rules simply codify the results reached by common or â€Å"case† law. Judicial decisions interpreting constitutions and legislative enactments also become sources of the law themselves, so in the end the basic perception that the American system is one of judge-made law remains valid. At the same time, not all law in civil law countries is codified in the sense that it is organized into a comprehensive organic, whole statement of the law on a given subject. Sometimes individual statutes are enacted to deal with specific issues without being codified. These simply exist alongside the more comprehensive civil or penal codes of the system. And while decisions of the higher courts   in a civil law jurisdiction may not have the binding force of law in succeeding cases (as they do in a common law system), the fact is that in many civil law countries lower courts tend to follow the decisions of higher courts in the system because of their persuasive argumentation. Nevertheless, a judge in the civil law system is not legally bound by the previous decision of a higher court in an identical or similar case and is quite free to ignore the decision altogether. The Concept of Precedent In the United States, judicial decisions do have the force of law and must be respected by the public, by lawyers and of course, by the courts themselves. This is what is signified by the â€Å"concept of precedent,† as expressed in the Latin phrase stare decisis — â€Å"let it [the decision] stand.† The decisions of a higher court in the same jurisdiction as a lower court must be respected in the same or similar cases decided by the lower court. This tradition, inherited by the United States from England, is based on several policy considerations. These include predictability of results, the desire to treat equally everyone who faces the same or similar legal problems, the advantages to be gained when an issue is decided that affects all subsequent cases and respect for the accumulated wisdom of lawyers and judges in the past. But it is also understood that primary responsibility for making law belongs to the legislative authority; judges are expected to interpr et the law, at most filling in gaps when constitutions or statutes are ambiguous or silent. Thus, there are important limiting features to the concept of precedent. First and foremost, a court decision will only bind a lower court if the court rendering the decision is higher in the same line of authority. For example, a decision of the U.S. Supreme Court on a matter of constitutional or ordinary federal law will bind all U.S. courts everywhere because all courts are lower and in the same line of authority as the Supreme Court in such matters. But decisions of one of the several U.S. Courts of Appeals — the intermediate federal appeals courts — will only bind federal trial courts within their respective regions. Decisions of a state supreme court on the meaning of a state law where that court sits will be binding everywhere, so long as the state court’s decisions do not conflict with constitutional or federal statutory law. American judges tend to be very cautious in their decision-making. As a rule, they only entertain actual cases or controversies brought by litigants whose interests are in some way directly affected. In addition, judges usually decide cases on the narrowest possible grounds, avoiding, for example, constitutional issues when cases may be disposed of on non- constitutional grounds. Then, too, the â€Å"law† that judges state is only so much of their decision as is absolutely necessary to decide the case. Any other pronouncement on the law is unofficial. Another important limiting feature of the concept of precedent is that the later case must be the same or closely related to the previous one. Unless the facts are identical or substantially similar, the later court will be able to distinguish the earlier case and not be bound by it. The highest court of a jurisdiction, e.g., the U.S. Supreme Court for the United States or a state supreme court within its own state, can overrule a precedent even where the facts of the later case are identical or substantially similar to the earlier case. In 1954, for example, in the famous school integration of Brown v. Board of Education, the U.S. Supreme Court overruled an analogous decision it had rendered in 1896. But such direct over-ruling is not common. What is more likely is that the high court, by distinguishing later cases over time, will move away from an earlier precedent which has become undesirable. But for the most part, the long standi ng precedents of the high courts remain. An Organized Law Where does one go to find the law in America? It might be supposed that with both enacted law and judicial decisions comprising the law, the search would be difficult. But the task in fact is relatively easy. Even though much American law is not codified, it still has been systematized and organized by subject matter. Legal encyclopedias and treatises written by learned professors and practitioners set out the law in logical sequence, typically providing historical perspectives as well. These books of authority contain references to the principles and specific rules of law in a given branch of law, as well as citations to relevant statutes and judicial decisions. Accessing statutes in â€Å"codebooks† and cases in bound volumes called court reports, and nowadays accessing both by computer, is a relatively straightforward undertaking. But it also bears noting that in the common law system, treatise writers do not have the same importance that they do in the civil law system. In civil law countries, such authorities are sometimesconsidered sources of law, looked to for the development of the doctrine relative to a given subject matter. Their statements are given considerable weight by civil law judges. In the United States, in contrast, doctrine developed by treatise writers lacks binding force, although it may be cited for its persuasive effect. Common Law v. Civil Law Apart from these features, there are a number of institutions associated with the common law system not usually found in civil law systems. Principal among these is the jury which, at the option of the litigants, functions in both civil and criminal cases. The jury is a group of citizens, traditionally 12 in number, summoned at random to determine the facts in a lawsuit. When a trial by jury is held, the judge will instruct the jury on the law, but it remains for the jury to decide the facts. This means that ordinary citizens will decide which party will prevail in a civil case, and whether, in a criminal case, the accused is guilty or innocent of the charge against him or her. The institution of the jury has had an important shaping effect on the common law. Because jurors are brought in on a temporary basis to resolve factual issues, common law trials are usually concentrated events, sometimes only a matter of days (although occasionally possibly weeks or months in duration). Empha sis is on the oral testimony of witnesses, although documents also are presented as evidence. Lawyers have responsibility for preparing the case; the trial judge performs no investigation of the case prior to trial. Lawyers, acting as adversaries, take the lead in questioning the witnesses at trial, while the judge acts essentially as a referee. Testimony is recorded verbatim by a court reporter or electronically. The trial court, which is the â€Å"court of first instance† (i.e., where the case is first heard) in the American system, is where the factual record of the case is made. Generally speaking, appeals courts confine their review of the lower court record to errors of law, not of fact. No new evidence is received on appeal. All this stands in marked contrast to what is usually found in civil law systems, where jury trials are for the most part unknown. In a given case, instead of a single continuous trial, a series of court hearings may be held over an extended period. Documents play a more important role than witness testimony. The judge actively investigates the case and also conducts the questioning of the witnesses. Instead of a verbatim record of the proceedings, the judge’s notes and findings of fact comprise the record. Appeals may be taken both on the facts and the law, and the appeals court can and, sometimes does open the record to receive new evidence. Despite their differences, both the common and civil law systems have as their goal the just, speedy and inexpensive determination of disputes. U.S. courts have become particularly sensitive in recent years for the need to continuously reappraise their processes in order to improve the quality of justice. As a consequence of these efforts, there are many other aspects of court activity in the U.S. These range from alternate dispute resolution mechanisms (including arbitration and mediation) to such procedural devices as default and summary judgment, used by judges to decide cases at an early stage without having to proceed to a formal trial.
